The Delhi High Court has confirmed that personal freedom of two consent adults is protected under Article 21 of the Constitution of India to marry and live together in peace. In a recent judgment, the court emphasized that family opposition could not end this autonomy.
Justice Sanjeev Narula said that the Supreme Court has continuously upheld this principle, which directs the law enforcement to protect the couples from threats or force. In this case, the court ordered police protection for a young couple, who feared harassment from the woman’s family.
After Hindu rituals at an Arya Samaj Trust in Delhi, the pair completed their marriage on 23 July 2025.
The woman’s parents contacted the court after allegedly voluntary departure departure from her family home and clear confirmation of marriage during police investigation, allegedly tried to pressurize her. The inquiry, launched after a “missing” complaint, was later closed.
To ensure their safety, the court directed the local Station House Officer (SHO) to hand over to a beat officer, to abstinage them on the directions of the court and provide an emergency contact number to the couple. Any reported dangers should be documented and addressed without any delay.
Justice Narula clarified that the court was not ruling the veracity of the allegations, but was completely focused on protecting the fundamental rights of the couple for life, freedom and dignity.
