Scottish Labor MSP Colin Smith has been arrested and accused in the possession of abusive images.
The 52 -year -old, who has represented South Scotland since 2016, was arrested earlier this month in a property in dumps.
Smith has been suspended by Scottish Labor and is now listed as an independent on the Parliament website.
He is due to the subsequent appearance in the Damfrees Sheriff Court at the later date.
Smith has played several frontbench roles, recently in April 2023, and first served as General Secretary of Scottish Labor.
His phone was responded to, but when the BBC Scotland News tried to contact him for the first time.
However, Smith later issued a statement in which he said: “These incidents have come as a shock and this is a deep stressful time.
“I am clearly cooperating fully with any inquiries and hope that the case can be resolved quickly.
“I am not able to comment further at this level.”
A labor spokesperson said: “Whip has been removed from Colin Smith MSP, an investigation pending.
“We can’t comment further on the matter while the investigation is on.”
It is understood that the party suspended Smith over the weekend when it was revealed about the police investigation.
Smith was arrested on 5 August. He appeared in a video with the Scottish labor leader Anas Sarwar, which was posted on social media two days later, but has since been removed.
