New Delhi: The Supreme Court rescued a young man, who came out impulsively with a college girl and stayed together in Hyderabad for two months, but for the next 13 years the person faced the rigor of police investigation and later, convicted of kidnapping and rape by the trial court and Telangana HC.A bench of Justices Sanjay Karol and Sandeep Mehta acquitted the man of all the allegations to find out that the couple were in a consensus and had come to their own will. The trial court convicted and sentenced him to seven years rigorous imprisonment, which was reduced by HC to two years.The man worked with his friend’s sister on August 4, 2012, and the couple stayed in Shadnagar, Hyderabad. The girl’s mother lodged a missing complaint with the police on August 8. On 12 October, the person met with an accident riding his motorcycle and was admitted to the hospital. The girl returned to her parents’ home that day. On his statement, the police registered a cedar against the man for kidnapping and rape.Analyzing the evidence produced before the trial court, the bench said, “The girl’s statement does not show that the man forcibly removed or deceptionly removed or convicted her from the patronage of his parents. The kidnapping of the police raises doubts.The bench said that when the man was admitted to the hospital after the accident, she stayed with him for two days. In rape charges, it said, “There are no legs to stand on this charge, as he only makes a positive statement about the sexual intercourse and it does not happen evenly to be against his will.”Reflecting him from all the allegations, Justice Karol and Mehta said, “We could not find any evidence, suggesting that the appellant kidnapped the victim with a valid mentor or for about two months, he worked against his will or without his sentence to have sexual intercourse against his will or the victim in a house in Hyderabad.”
