New Delhi, Supreme Court on Monday agreed to investigate a pile seeking direction to the Center to frame policies for a more equitable system of reservation in government employment.
A bench of Justices Surya Kant and Joylya Bagchi issued a notice to the Center and sought his response till 10 October to the genes filed by Ramshankar Prajapati and Yamuna Prasad.
The bench asked the petitioner’s counsel to be ready to face a lot of opposition as the pilot could have far -reaching effects.
Pilot, who was filed through advocate Sandeep Singh, said the approach would strengthen 14, 15 and 16 articles of the Constitution and ensure a justified opportunity without changing the existing quota.
Despite the decades reservation, the most economically disadvantaged people were often left behind with relatively better-closed benefits within the reserved categories and would help to ensure that the most needed today.
“The petitioners who belong to the categories of Scheduled Castes and Other Backward Classes through the current petition want to highlight economic inequalities within these communities, thereby an uneven distribution of benefits under the existing reservation policies,” said the pilot.
It was argued, while the reservation structure was initially introduced for the upliftment of historically deprived communities, the current system within these groups benefits people related to the relatively well economic level and high social status backgrounds, which unevenly benefit the most economically disadvantaged members with limited access to opportunities.
“The petition asks for an immediate need to integrate economic norms in the reservation policy to ensure that the benefit is provided to those who actually require state support. This reform proposal does not try to eliminate or weaken caste-based reservations, rather he does not try to refine them to serve their intended purpose more effectively,” said this.
PIL introduced an income-based priority mechanism within SC, ST reservation and said, the purpose of the proposed structure is to prioritize opportunities for the most disadvantaged persons among SC-Sent communities.
“The need for such an approach stems from the fact that in the last 75 years, reservations have benefited a few selected people within the reserved categories, causing inter-social economic inequalities and have failed to achieve the overall uplift,” said this.
The petition stated that the quota system was established as a tool for social justice, the aim was to improve centuries of discrimination and socio -economic scarcity faced by marginalized communities.
